BUYER MADE A CC CHARGEBACK AND NEVER RETURNED THE ITEM

the buyer never contacted me and NEVER RETURNED my item. he has received the item but told to the cc company that the item was not as described.

 

it seems my money (more than $550) is away.

 

to paypal: is this the new way not to pay for items ?

 

WHERE IS THE SELLER PROTECTION ? WHERE IS YOUR HELP ?

Since this is a chargeback and not a PayPal dispute, the buyer may not be required to return item to you.  If the reason for the chargeback is Not As Described, you are not covered by PayPal seller protection.  PayPal does not cover Not As Described disputes too so sellers are required to accept returns.  They are covered for Unauthorized Use or Item Not Received.

I sold the item on ebay and he paid with paypal.

then after a few weeks he made a chargeback over his cc company.

he never made an ebay or paypal dispute and never responded to my emails.

he never sent a claim to me.

the item I have sold was new with all tags and labels, exactly as described.

SO WHY IS THE BUYER NOT REQUIRED TO RETURN THE ITEM ?

Do we talk here about a new business model ? Buying an item, making a chargeback and then not sending back the item ?

It is all up to the card issuer when it comes to chargebacks, they may not require the buyer to return.  When a buyer files a chargeback, it is against PayPal's account or bank and PayPal has to gather the info from you and fight the case on your behalf.  You can tell PayPal to tell the card issuer to arrange a return for a refund if the case is still pending.  Some buyers do not want to deal with the seller and have the card issuer and PayPal fight it out.

where did you sell the item and what is your return policy?

the problem with accepting credit card payment vis Paypal is that you dont know what your buyer told his cc issuer.

I sold the item on ebay. it was a jacket in brand new condition with all tags and labels. he paid via paypal.
Im always willing to accept returns but he never asked to return the item. he never answered any questions.

Get eBay or lawyer involved.
