who pays return shipping of damaged product

I recieved expensive speakers that were damaged in UPS transit. The seller neglected to purchase insurance. Is the seller obligated to pay the $250.00 shipping fees to return the item?

WHY DOES IT TAKE $250 TO SHIP SNEAKERS?

HOW MANY PAIRS?

UPS is responsible,they should come and pick up the sneakers from you,call either UPS or tell your seller to call UPS

There is no regulation to handle this.  This is not a PayPal area to control and is not part of buyer protection.  It is up to buyer and seller.  This is where the reputation and honesty of the seller come into play; this is when buyer judgement is extremely important before the purchase.

 

Here's what should happen, from a business perspective.

 

The first step is that seller must be convinced that the damage did occur during shipping.  How this is communicated to seller is up to buyer and seller.  So, at this point the assumption is that the seller has accepted that the damage did occur.

 

It is seller's reponsibility to get product to the delivery point SAFELY and on time.  If the product arrived damaged for ANY reason, seller is reponsible to correct and at seller expense.  Seller's have mutliple options to consider.  If seller wants the product returned, then it is seller's responsibility to pay for return shipping.  It may be that the damaged value of the product isn't worh the shipping cost to return.  In that case the seller should just refund all product cost and shipping.

 

Since the seller didn't purchase insurance, then it's just a business loss for the seller.

Anymore information would be great as my purchase is currently on a "chargeback" with a bank wire to palpal. The seller is not bargaining faithfully and an advisor from the audio site that posted the ad has told me infatically that I'm liable for return shipping costs even though the seller has received $100.00 for the damaged speaker since he neglected to buy insurance.

I'm guessing that this was an international purchase.  Such a purchase has much higher risks.  Electronics also are high risk of problems.

With internnational sales, the sellers know that that there are a lot of hurdles for the buyer which means buyer accept most of the risk.

2 options:

 

If you filed a "chargeback" with your card/bank, not a PayPal dispute, they may not even require you to return it and give you a refund.  Or is the card/bank asking you to work out an arrangement with the seller? If you can not come to an agreement with seller, tell your card/bank through the chargeback.

 

If you filed a PayPal dispute, PayPal will rule in favor of you but you are responsible for return shipping costs of item for a refund.  Yes, that is the policy.  Although, you may be eligible for full or partial reimbursement of your return shipping by googling "PayPal Return Shipping US" or wherever you are based and activate it for your account and submit a reimbursement request. Be sure to read the terms and conditions of the return shipping program to see if you are eligible to use and how to submit request and what documents are needed. Keep complete records (payment receipts, shipping receipts) pertaining to the transaction as it may be needed for reimbursement. You may use your country's postal service to return instead of expensive UPS but make sure it has tracking number so you can submit it to the PayPal dispute.
