Depop scam? Will I get my money back?

Hi, this is my first time posting here. I recently bought something off of depop through PayPal for a good bit of money. I’ve waited over a week for the item to be shipped and going back and forth with the seller saying they’ll tell me when they’ve done it and they never have. So it led me to believe I won’t be getting the item and could be getting scammed so I opened a case and the seller is trying to partial refund me even though they’re the ones who hasn’t made effort to ship the item and after arguing with them I asked for my money back or item and I’ve got non. I’ve told them to send it to me but have reason to believe I won’t get it. What would happen once I escalate this to PayPal? Would I win the case, they’re saying that over 100 pound they should keep all because of their packing of the item. To which I’ve refused and said just send it then but I don’t believe they will so I’ve said send it or give me my money back because I’m sick of arguing. Can anyone give me any advice regarding this? I’m just worried as I spent a lot of money and this seller believes they deserve money from me for something they’ve no intention clearly to ship.

if you opened a dispute for non receipt of item then the seller would probably have to give you a complete refund if they can't prove delivery of the item to you with a tracking number.

Thank you @kernowlass . The seller has now sent me several requests for a partial refund stating he has taken a fee of it for his time and packaging the item and saying this is for cancellation as his shop policy is no refunds and no returns. I replied in the dispute that he’s the one so insistent on cancelling it I’ve tried many times to ask him to ship it and even said I’ll give him a few more days to ship the item until I escalate but he keeps sending the same offer. I also believe it is a scam as he’s sending me partial of my money and saying I can keep the item when he’s not sent it and the item is worth a lot of money to just say I could keep. I’ve said his shop policy is irrelevant when he’s not sent the item to begin with or made effort. He’s had over a week to ship it and he says he’s happy to take it further? I don’t understand how I could be in the wrong when I told him either send me the item I paid for or refund me in full if you won’t. Whilst messaging on depop he offered to refund me a few times when I spoke to him about when he will send it the first few times I declined saying I want the item. The last time I said you may as well give me my money back as you’re clearly not going to ship it and wasting my time? How does he deserve a fee of my money I paid for an item for apparently using his time and packing when he’s done the exact same time wasting my time and my chances to get another of the same item from elsewhere? I’m just worried as this is the first time I’ve had an issue as such and I don’t want to lose my money for something I purchased and haven't got. I’ve said to him if he isn’t going to post as I’ve stated within the time frame and continually gives me the same offer of refund then he may as well just tell me so I can escalate earlier to get my money back sooner... have I done right by this?

Okay thank you. He’s sending me the same offer saying I chose to cancel the order when I opened the case and it’s his shop policy for no refund or returns. I’ve stated opening the case means I didn’t get the item and it would’ve been solved if you just sent me the item, I’ve gave him opportunity to ship it before I escalate but he keeps sending the same offer trying to refund me a partial amount saying he should keep a fee for his time packaging the item. I said he should just ship it and if he won’t give me a full refund. How does he deserve a fee when he’s not giving me the item and wasting my time and chances to get the same item elsewhere as he isn’t giving it me. His shop policy is invalid when he’s not sending me what I paid for. I told him I’d wait to escalate to give him chance but I’m considering escalating now because it’s clear he’s not sending it I’m just worried as I’ve never been in a situation like this before.
