Harry Potter Fraudulent Lego Seller on Ebay

I recently raised a case with PP in relation to an item I bought pre-Christmas, as a Christmas present for my daughter, advertised by the seller on Ebay as a Harry Potter Lego set. Pictures on Ebay showed everything as Harry Potter, down to the box and the dimensions of the box it was supposed to arrive in. When I received it just before Christmas, it came only in a plastic bag and when I opened it I found I had purchased something called 'Justice Magician'. Nothing to indicate it was in anyway Lego and it certainly wasn't Harry Potter Lego. I raised a dispute with the seller who offered me a refund of $6 then $20 and then a full refund if I removed my negative feedback - warning other buyers this was not Lego. I refused. I reported the seller to Ebay and raised a dispute with PP for a full refund. I did not want to return this item to the seller, happy to destroy it as I couldn't give it to my daughter for Christmas. I was advised by PP I would only receive a refund if I returned it to the seller but would receive a refund for my postage. This is wrong, why should the seller get the item back only to then be able to onsell it to some other unsuspecting buyer? I have lost the case because I wouldn't return it AND the seller is still on EBay!! Buyer beware of seller https://www.ebay.com.au/usr/perfect-tradeonline-uk

If you had provided written proof on company headed paper from a shop / company that sold / made that item OR trading standards and stated you had that proof when you opened the dispute then you would not have had to return the item.
As its against the law to sell fakes Paypal don't expect you to return fake goods BUT the onus is on your to prove its fake first. (Otherwise every buyer would claim something was fake to save having to return it).
Advice is voluntary.

Hi, all of the pictures on the Ebay Sellers listing showed the Harry Potter Lego set with the registered trademark and the listing described it as a Lego Harry Potter set and showed the dimensions of the box it was supposedly being sent in. My item arrived in a plastic bag and the instructions that came with it has 'Justice Magician' on it with 3 lookalikes posing as the original cast. Clearly listed to deceive and and clearly fraudulent items. I offered to send photo's but PP did not respond. I also advised PP that they were fraudulent items. In the past I have been requested to send photo's and to destroy the item if fraudulent. In this case they just said to send it back. Seller is still listing same items on Ebay. This is wrong on all levels. Hoping my negative feedback at least warns people as I refused to delete it even for a full refund.
