Stolen packages

I have an ebay purchase that shows delivered by fedex but I never received the package.  Seller/shipper has done nothing. I opened a dispute on paypal and they have taken the shippers side, that I am responsible for the package once Fedex leaves it on my porch. FedEx say they need to file a claim (shipper) and that I can not. Shipper says no refunds or replacements.  This isn't correct but I'm completely powerless.

Any advice on how to proceed?

Did you purchase using a credit card? If so did you ask the credit card company in regards to purchase protection? Mine covers stolen items and is allowing me to proceed with a claim. Will see what happens.
