Tomtop drone order

Hi guys, im not new in online shopping but this is my first order with tomtop. So i payed 94$ for a drone on 14.12. And they say on their website that shipping time is 7-12 business days. Duty free. On tracking my item arrived in Switzerland on 9.1.2019. From that date nobody know where is. I contacted swiss post because they are sending it from spain to ger than swiss and than?????? And they said: As no delivery of your shipment can be shown within the usual transport time we recommend that the sender launches an investigation in the country of origin. The sender chose the non-insured shipping method for your item. Therefore please refer any claim for compensation to the sender. Now i opened dispute here on paypal but sender replied to wait ofc. Always same generic mails. Now sender dont even replies to my emails and on this dispute. Is it smart and ok for me to escalate claim? Its 94$.... Can i loose that money somehow??? Thanks in advance
