Grounds for Lawsuit Paypal regularly violates Visa guidelines

I recently bought some items from someone off of proxibid who lied about what they sold me... it was not a paypal transaction ..but does pertain to paypal. So i contacted my bank to get it refunded...one rep told me i had to hold onto the merchandise until my banks claims dept contacts me...about 10 days later i found out he was wrong.. I was told that I have to return the merchandise in order to get refunded, that VISA would not refund anything unless the guy got his stuff back. To give the guy an opportunity to refund me otherwise then visa steps in... which brings me to paypal. They have consistently refunded buyers monies even without the merchandise being returned. Which is in direct contradiction of Visa business practices...
visa refuses to refund money if the seller has not received their merchandise back... I know many sellers have been burned by buyers who claim not as received and paypal give them the money back without requiring the buyer to return first. Seems like grounds for a lawsuit to me, to engage visa and paypal in ..
