Hi,
I recently purchased a ride on mower via Buy It Now which offered delivery anywhere in the UK. The seller then communicated once to say he would have the item collected and delivered later in the week, but failed to respond to any more messages. I became wary as the offer of free delivery anywhere in the UK seemed unrealistic for such a large piece of equipment. I communicated further with the seller but received no response and have received no further communication regarding delivery and certainly no sign of the goods. I then discovered that it clearly was a spoof listing as the images and description had been taken from a previous listing that completed only 3.5 weeks before in a completely different area of the country. I raised a case on eBay and one on Paypal (raising the case on Paypal caused the eBay case to automatically close).
I have now escalated the Paypal case to dispute and am waiting for Paypal to resolve. However I have just noticed that Paypal Buyer protection does not cover 'motorised vehicles (of any kind)'. Does this mean that I have no buyer protection on this transaction? I made this purchase, in good faith that eBay and Paypal protect against non-delivery, and was not aware of items not covered by Paypal protection. Does this mean that non-delivery of an item not covered by Paypal buyer protection, when the whole listing is clearly a scam, receives no protection?

You may well not be covered, all you can do is wait and see if paypal decide to reimburse you or not.
The idea is that paypal give you buyer protection but it is not a 100% coverall so you are supposed to actually read the small section on it in the user agreement so you can then risk assess your transactions.
BUT if you don't get your money back via paypal then IF you funded your paypal payment via a card then contact your card issuer and see if they will chargeback for you.

I used pay after delivery direct from a linked bank account. Can I ask my bank to block that pending transaction from going through? It's not due to leave until 19/6/17.
I do think that Paypal needs to make this limitation to their protection clearer.

You can ask your bank BUT if you lose the dispute and have not paid then paypal may well put your paypal account into ''negative'' until you pay them back again.
This is because they have already paid the seller on your behalf and the PAD payment is to reimburse paypal for those funds.

Thanks for that further answer @kernowlass. This might be outside your sphere of advising, but I have raised a question on the eBay community as well. If Paypal protection doesn't cover this, would the eBay money back guarantee cover it as a non-delivered item? At the moment, I can't re-open a case on eBay because I've got the case open on Paypal.

As with every programme like this, there are some rules. Here they are:
- eBay Money Back Guarantee protects you in case you do not receive your item or if the item is not as described in the listing. If this happens, you need to tell your seller within 30 days of your actual or latest estimated delivery date.
- The programme is designed to protect purchases that are usually sent by post – over 99% of listings on eBay. It doesn't include vehicles, real estate, businesses for sale, digital goods or services.
- To use the eBay Resolution Centre you need to have paid with Paypal, using your PayPal account. If you have paid as a PayPal Guest you cannot use this process, but you are of course still covered by PayPal Protection.
- This programme is limited to purchases on eBay.co.uk but if you have purchased on ebay.com or ebay.de, this is probably covered by similar programs in these countries. If you purchased on another eBay site and paid with PayPal, this is probably covered by the local PayPal Buyer Protection programme.

Thanks for that @kernowlass. I've now spoken to Paypal and they've assured me that if the seller doesn't respond at all, the full amount will be restored to my account, absolutely! So I hope all will turn out okay.
