WILL I GET MY MONEY BACK?

Hi,

I'm in the UK and currently have a Paypal claim which hopefully I will win as I paid for something and haven't heard from the seleer since. I'm pretty sure they have closed their Paypal account as the dispute was escalated straight to a claim. My question is that if the "seller's" Paypal account has no money in or is closed can Paypal still give me my money back? I've read conflicting info on this. Also, what if the seller doesn't have funds in his bank account? Does that make any difference?

With not as described the outcome is not so certain. the onus is on you to prove its misdescribed so you must give as much info as possible.

 

Also if its fake the onus is on you to prove this with a letter from a dealer that sells the item or the company that makes them or failing that trading standards, so don't open the dispute till you have the proof as it can take time, you have up to 45 days to open a dispute and another 20 days after that to escalate it to a claim.

 

However once you have opened a dispute the seller may decide to refund you without you having to send the item back.

 

If fake paypal often don't expect you to return it as you are not allowed to sell fake items however if just misdescribed you may have to return the item at your own expense trackable before paypal award  you a refund of the original payment you made to the seller.

 

Check feedback of sellers and also their DSR ratings before you bid, also if they are a business seller they have more obligations under distance selling rules.

 

If you need more info on the ebay item go to the ebay boards where there are oodles of sellers and buyers there with loads of experience that will help you.

If the claim was found in your favour and their are no funds in the sellers paypal account then paypal will pay you back and go after the seller to get their funds back.

 

They can't take from his bank account etc if no funds in his paypal account they put his account in neg and try other means to get their money back.

 

Not your problem as buyer protection means paypal would have already refunded you.

Thanks for that. Are there any reasons i might not be covered by the buyer protection policy? This issue was with an Ipad bought from someone but was not Ebay although I have also just bought one off ebay which i suspect i may also have to claim for as the seller just doesn't seem right and it was very cheap. Ps the seller has ten days to reply and it doesnt look like he will. In this case would Paypal just refund me when the ten days are up?

Buyer Buyer protection protects you even if its not an ebay transaction.

 

If the seller does not provide a tracking number to prove delivery of the item to you or a refund then after 10 days paypal will refund you.

Thanks again. How might things pan out if the other one off ebay turns out to be "not as described" such as a fake or empty box, etc? I've just got a feeling that this may happen. I presume the onus is on the seller to prove it is genuine and i'd be more than happy to return it so do you reckon i'd have any probs if something like this were to happen. Ps the seller on ebay didnt actually do a description but entered the title and item spec as a genuine apple ipad and the listing says returns accepted as well.

Hey I have the same problem, what will happen to the seller if they don't respond to my claim? Will PayPal take legal action or just shut down their account and give my money back? Its been 10 days and I think it's their last day.

same thing just happened to me on a pair of Air Jordans and I'm waiting on a response..I hope it doesn't take long for the refund. How long did it take for you??
