John Lewis dispute, says item delivered!

Hi all,

 

I bought a large volume order from John Lewis recently - consisting of an iPad and other smaller gadgets! Delivery via DPD.

 

I purchased on the 15/09/2022 and I received an email on the 16/09/2022 saying it would be delivered on 21/09/2022 and may require photo ID. I ensured I would be home on 21/09/2022.

 

Then on the 17/09/2022 I received an email from DPD saying this item was delivered to my porch, and an image was attached, this was my porch. I was out at the time of delivery, when I returned home my porch door was open and there was no parcel.

 

I contacted John Lewis immediately via their email, WhatsApp, Facebook and multiple phone calls. I have history of all this. No one was able to help me. Today I received an email from JL saying that apparently according to DPD my delivery was compliant as this was the safe space I had selected. I have no account with DPD and have not selected any safe space. Moreover, this was a high value order, £1500, therefore photo ID/signature/handing to a resident would be a sensible option. John Lewis said they could not offer me a refund and to go through Paypal to dispute instead.

 

I have submitted my dispute via Paypal and have escalated it, alongside attaching all the times I attempted to contact John Lewis on different platforms. I have highlighted this was not my safe space, and they did not deliver on the day that was agreed. I ensured I would be home on the delivery date of 21/09/2022. so this would not have happened!

 

I was concerned to find information on the forum saying that as JL can supply tracking info/ that it was delivered, Paypal will not rule in my favour! This is ridiculous. They left the parcel somewhere that was not agreed, and delivered its on the wrong day. I cannot afford to be £1500 out of pocket, how can I strengthen my case? Is it likely I will win?

 

Please help - it seems unfair that all 'proof of delivery' via the seller are tainted with the same brush. My delivery was delivered to a location that I did not agree on, a breach of the Consumer Rights Act.

I understand how frustrating this must be for you. 

 

As per our Buyer & Seller Protection Policy, we require proof of delivery via a tracking number. As this can be supplied, unfortunately, you would not be refunded via a PayPal case. 

 

It sounds like the item was stolen from your doorstep, this would need to be referred to the police and investigated. 

 

I am very sorry that I cannot provide you with the answer or solution you were hoping for today.
