I have a dispute with a Chinese company that have fraudulently sold a counterfeit item to me I opened a dispute and they have requested that i send it back at my expense, the following question s arise,
1, How can Paypal allow these sort of transactions.
2, why have I got to bear the expense of sending the item back and therefore lose money.
3, why am I being requested to send an counterfeit item through the UK post which is plainly against the law.
4, If I comply and send it, can I be complicit in a crime?
I am very angry about this not only breaking the law but paying for it as well.

Its not against the law to sell fake or counterfeit goods in China.
It may be against UK law to knowingly purchase them but obviously that does not apply in your case.
So the China seller has the right to a return of item for a full refund.
If you had purchased from a UK seller and shown written proof from a seller that sold OR a merchant that produced the item then you may not have been requested to return said item. However >>>
Paypal state this >>
IMPORTANT: You may be required to return the item to the seller or other party we specify as part of the settlement of your claim. PayPal Buyer Protection does not entitle you to reimbursement for the return shipping costs that you may incur.
Although they will compensate you for some of the cost if you have activated this at some point before you made that transaction.

You also have the option to do a chargeback via your card issuer instead of a Paypal dispute if you funded your Paypal payment via a credit card.
Advice is voluntary.
Kudos / Solution appreciated.

It may not be against the law in China to sell counterfeit goods but it most certainly is against the UK law to knowingly send counterfeit items in the UK post, I.E. counterfeit banknotes etc and the item I bought is a counterfeit of a Saker tool and it shows a Saker tool on the sellers sale page.
