Refurbished item refund request

A buyer is unhappy and wants a refund because a vintage musical instrument he purchased was not in original factory condition. It was advertised as in excellent condition with clear, close up photos that show that it has been refurbished and is not in original factory condition. Nothing was stated that it was in original condition. Will he be eligible for the refund?
