I need some help with which legal jurisdiction to pursue a claim against PayPal.
I have been a PayPal business user for many years and up until now been satisfied.
However in mid-October I had 4 fraudulent payments taken from my account.
This was put to Paypal who eventually decided 2 in my favour and rejected the other 2.
However I know these are 100% fraudulent for reasons I gave to PayPal on ‘appeal’ yet despite that they have still decided against me (how 2 can be fraudulent and 2 of the same amount to the same payee on consecutive dates not be fraudulent strains my understanding).
I am an 83-year pensioner and I cannot afford to lose over 750 euros so I am left with no alterative other than to take the stressful step of taking Paypal to court since apparently there is no further room to appeal
So my question is this: under which jurisdiction should I take the action?
- Ireland – since that is where I live; or
- Luxembourg – since I believe that is where the registered address of Paypal is in Europe; or
- The jurisdiction of the payee – but this is impossible because PayPal say they have no address on file.
- PayPal USA
I would appreciate some advice on this since using PayPal message service has not got any results.
