Thanks for the input andy. i have now solved this as of 10th of august and will post the answer to help others in the same boat. I Live in the UK and therfore this only applies to uk law (i would have thought) I spoke to Consumer Direct about the issue and i also spoke to paypal, and it appears there is really no legal say so. I dont think you can legally OWN the item, however if you can prove youve done everything in your power to contact the person and send the item back then the laws on your side and you can arguablly do what you want with the item. Evidence I asked paypal to send me all the relevent details and how many times they had tried contacting him, i myself have also printed off the emails i have tried to send to him, which are dated and proves how long ive been trying to contact him for. So long story short, if youve done (and can prove doing) everything you can to get the item back to him then do what you like with it it may as well be yours now 🙂 hope this helps people
