Dispute Resolution Process, Final Decisions, Timeline

I am writing about a dispute filed when I purchased a watch from a seller that was "not as described" and "missing parts" because it was sold as a working watch with the original box.  The watch arrived in non-working condition without the box.  The watch was missing parts that resulted in the watch not working. 

 

Prior to contacting Paypal, I attempted to resolve the dispute with the seller.  The seller required me to have the item repaired at my expense.  I then filed the dispute. 

 

I did not have the item repaired but had the item inspected by a watchmaker with over 40 years expense.  The  highly respected watch maker determined the watch was missing a gear to set the date and moon phase complication.  In accordance with Paypal protocol, I then sent the item back as required but the seller refused to sign for the item.

 

I submitted evidence from watchmaker that watch was missing parts and therefore did not work hence was sold not as described. The evidence was a letter and reciept for payment for the inspection from the watchmaker provided to Paypal.

I submitted evidence that I sent the item back to seller.  A UPS receipt and tracking number sent to Paypal.

I submitted evidence that the Seller refused to sign for the returned item.  A letter signed by the UPS Store General Manager and an email from UPS international to Paypal.

 

 

I am concerned by the the fact that the seller refused to sign for the returned item when that is part of the paypal protocol yet I have no control over the seller's actions.  I provided eveidence that seller refused to sign for the item.

 

Paypal has yet to resolve the case and it has been under review for weeks.  The original transaction is now months old.

 

What more evidence does Paypal need to resolve this matter?

according to AMEX,signature requirement is Ebay and PAYPAL's ideas,not credit card industry,now thats AMEX dudes saying,they speak for AMEX,not sure if it is true for MC and Visa.

Be it as it  may,you should file a chargeback with your cc issuer,it will close the paypal case and it becomes a cc chargeback.

your cc issuer will review your dispute and notify PAYPAL a chargeback has been filed and Paypal will notify the seller.

YOu may want to call your cc issuer and ask if seller refused to accept the return,what happens?

make sure you submit your dispute clear and concise,showing the UPS document he refused the watch.

yu may end up keeping the watch and get your money back,while he would be socked with a $20 chargeback fee.

I k now with Ebay,no return and refusal to accept return,means seller does not want the item back,so buyer get  his money back and keep the item.
