Refunds on an open case

I am trying to work with a seller on a refund. I have an issue with a product I purchased on eBay. I opened a dispute with PayPal. Now the seller states they will refund my money. But cannot do so while there is a dispute open. From what I understand, PayPal says don't close a dispute until has been resolved. I guess I'm not sure what to do.

WHAT KIND OF DISPUTE DID YOU OPEN?

ITEM NOT AS DESCRIBED,YOU WOULD NEED TO RETURN THE ITEM WITH TRACKING FIRST.

OPEN IT ON eABY ,SELLER would have to pay return shipping

Yes, they can refund with case still open in the dispute or waiting-for-seller-respond phase.  It's what cheating sellers say to get you to close the dispute.  Once you do, you won't hear back from them and they get to keep the money.  If the case is escalated to a claim, the seller has to ask PayPal to issue refund.
