Tracking status shows delivered but item was not received.

I need help and advice. I previously ordered 3 different items($9+$1+$69) on Gearbest.com(they say item should reach buyer n 15-25 business days) on the 28 Aug 2016.

 

On Monday 19 Sept 2016 I received 2 items ($9+$1) and went to the PO to collects them. At that point i was expecting for my 3rd order($69) to reach during the same week.

 

I was checking the tracking status of my 3rd item almost every 3-5 hours and on Tuesday 20 Sept 2016 when I went on the tracking website, it showed that my item's delivery was unsuccessful and the hours after that it changed again to "delivery successful" but i did not receive any notice or anything from the PO and i decided to wait another 24 hours hoping maybe it will reach but the next day it did not.

 

I opened a case with the seller via paypal dispute and they take a really long time to reply. They say that they have online evidence that the item was delivered BUT HOW AM I SUPPOSE TO PROVE THAT I DID NOT RECEIVE IT???

 

I went to the PO on the seller's saying and there i asked them if there was any parcel for me and they said no and that if there is any parcel they will send a notice.

 

I went back home and messaged the seller about that and he said that at this point they offer me 2 solutions, 1-Resend(i will have to pay another $35) 2-Partial refund(they say they will refund only $35) I told the seller that i don't want to wait any longer and that i want my refund and if possible a FULL refund.

 

I waited another 10-12(or more) hours to finally get a reply today (Friday 23 Sept 2016) that they are contacting the shipper to get more information about the delivery and that i need to contact them after another 5-8 business days. And i replied that i don't want to wait any longer and i want my refund.

 

My question is:

1- Do Paypal cover me ? I cannot wait any longer, the parcel MAY have been delivered but not to me.

2- What should i do at this point for the seller to refund me my full amount?

3- Should I escalate the case to paypal? Will my get my money back of will paypal take the buyer's side?

 

I really hope that paypal can get me my money back.

1. If the tracking number provided by the seller proves delivery of the item to you then any non receipt dispute would probably fail.

 

2. Work with them and allow them a bit of time to sort it with the shipping agent.

 

3. You need to escalate within 20 days of opening the dispute, when you do so is up to you but paypal do not become involved until you do. HOWEVER if you do then the company may be less likely to work with you to sort your refund and may just leave it for a paypal decision (re-red point 1).

 

If none of the above work ie company does not refund and paypal don't find in your favour then if you funded your paypal payment via a card then contact your card issuer and see if they will chargeback for you.

The seller said that it is the shipper who is to and that they would either resend the item for 30USD or they will give a partial refund.

What carrier did they use to ship the item?

You received 2 shipments via USPS,is this item shipped USPS?

Ask them for the tracking number,if it is USPS,you post office can help you where did the shipment go or you can go online to USPS to find out.

One common scam is to ship USPS to an address in your neighborhood ,same zipcode an empty box or some nonsense,so tracking would show delivered.

Your post office would be able to tell you where it was delivered to.

well,you can play the same game,after you lose the case of item not received,file item not as described and return an empty envelope with tracking.

PAYPAL robot will refund you !

if you have paid with credit card,file a chargeback with the cc issuer.
