Buyer purchased item on Ebay, no longer have it in stock. Can't issue refunds, account under review?

The buyer deserves his money and I deserve to be able to refund his money so that I can clear this on my ebay profile. I cannot issue a refund because my account is under review and I am on medium limitations at the moment. What can I do to resolve this? I need to clear things on my ebay profile, aswell as I don't want to have this money pending if I don't have the item in stock anymore and the buyer can't have his money back because of paypals choices.
