Monarch Airlines refund

I paid for a return flight on Monarch via Paypal on 3rd Jan 2017. As it is over 180 days am I unable to make a claim? I cannot get through to anyone in Customer Services to ask as the automated system does not cover this query.

My experience with PayPal would lead me to believe otherwise. They have been consistent in their responses to my requests to waive the 180 days, I have quoted PayPal spokespersons reported in the press as waiving the policy in these exceptional circumstances and people on this forum and facebook who have claimed to have been refunded even outside the 180 days. Below have have pasted the latest response from customer services from which you will see why I am exceptiuonally sceptical of anyone who claims to have been refunded outside the 180 day limit.

Thank you for contacting PayPal.
You opened your buyer complaint case ID (PP-006-211-652-916) on (10/03/2017) which is after our 180 days deadline and as such, regrettably, we cannot look into this claim. Unfortunatelly this is also the resolution for monarch airline cases.
It is necessary for us to limit the timeframe for opening a buyer complaint. We have found that in most cases 180 days is a sufficient timeframe for a buyer to notify PayPal that they have not received their item, or that there is a problem with the item that they have received.
Additionally, we are required to specify a set timeframe in our legal agreements. This lets sellers know that they should keep their postal information and other relevant transaction details for this period. It also reassures buyers that should something happen with their purchase within a 180 day period, they can open a complaint with PayPal.
PayPal’s Buyer Protection offers an additional layer of security, however this does not affect your standard consumer rights and we advise that you consult with your countries Consumer Advice agency or Trading Standards for further information.
Although we cannot investigate your claim, your complaint has been noted on the seller's records. If you purchased the goods on an auction site, you could also contact the customer support for that auction site to find out if they have a protection policy in place. We also recommend that you stay in contact with your seller in order to reach a resolution.

I was originally told when I called that as it was exceptional circumstances they would be refunding people who had paid outside the 180 days but it would take time as they were working backwards date wise and as mine was last December it could take a while.
When I called again for an update I was told no I wouldn’t get a refund as it was more than 180 days ago!
Please someone confirm what is happening and surely if 1 person gets a refund even it it’s 181 days since they paid everyone should get one?

I strongly suspect that those that are outside the 180 days BUT funded their paypal payment via a credit card are being refunded.
This is because it saves paypal time rather than the buyer filing via their credit cards and paypal having to process and deal with the c..c companies and end up refunding anyway.
Advice is voluntary.

Hi kernowlass, I funded my payment by credit card and have still had no luck!
I have know asked Barclaycard to try a chargeback to PayPal as I have read some people have tried this and received a full refund.
I understand it is not PayPal’s fault but I felt safe and covered using PayPal and to be honest probably my own fault I was not aware of the 180 day rule. I can understand this rule if you buy something off EBay but surely if you can use Paypal to purchase flights or holidays this should be different?
Fingers crossed I get some joy from the CC company!

Hi Dan, well done in getting a refund.
I am in the same situation as you, paid for my two flights on 2 Dec 2016 and 8 Dec 2016, paypal saying it's outside 180 days so they can't do anything, my bank as well as it was via direct debit.
Would you please be able to help us and post a screenshot of your paypal refund? We could use it then as a proof that PayPal is treating it's customers unfairly. Please hide all your sensitive details when doing so, you can use imgur in example.
