Hello Paypal Community,
TLDR: Won items through auction on Buyee. Items were mentioned to be genuine but turned out to be fake. I refuse to arrange shipping (shipping estimate is around 400 AUD + roughly 300 AUD customs and duty tax) for illegal counterfeit product, Buyee refuses to offer refund. I have already escalated my disputes to a claim. What to do? What to expect? How can I ensure I get my money back?
I am currently in the middle of a dispute with Buyee Tenso for 4 products which totals up to around 1200 AUD.
Basically, I accidentally won 4 auctions on Buyee (I set a low bidding max price, bidding went over my max price but then the seller somehow was able to delete all the higher bids making me the winner). The listing photos and description mentioned that the items were genuine but when it arrived at Buyee's warehouse, closer and detailed photos of the items revealed that they were counterfeits (I had the authenticated by [removed]. Having found the item is a counterfeit and different from described, the item is basically stuck at the warehouse because I refuse to pay for shipping and Buyee refuses to provide me with a refund. How can I ensure that I win the dispute?
Initially I escalated my claims to item not as described and one of the dispute managed to reach the conclusion that I would receive a refund if I returned the item and provide tracking. Problem is, I don't have the item. The item is still in Buyee's warehouse. I called Paypal and a kind Paypal representative recommended that I change the case type to Item Not Received. What are my odds of winning the case now? Anyone had similar problems? I can't arrange and pay for shipping since the importation of illegals products to Australia would be illegal and I don't want to get involved in that. Can Buyee ship the item without my permission (I would have to pay customs tax if it does reach Australia)? Buyee also can dispose of my item. If Buyee disposes my item without my permission, am I eligible to get my money back?

I have good news for you. I did win the dispute and I did get my refund. Paypal was very helpful on the phone and via the message centre.
Basically, Paypal advised me to change my dispute type to Item Not Received. In order to win this case, the merchant simply has to not be able to provide a shipment tracking code. Since I did not pay for shipping, Buyee was not able to provide tracking, hence, I won the case. Got my refund about 1 week after I changed my dispute case.
After that, I basically asked Buyee to dispose the items and then I terminated my account.

I understand that you must have been frustrated with Buyee's customer service, because I was too. Fortunately, I have good news.
As long as you have not paid for the international shipping of the item to your address, you should most likely win a Paypal dispute for Item Not Received because Buyee won't be able to provide shipment tracking. Please read my reply below to the other person who commented. 😄

Just want to know whether the item dispute option worked out, I have some items I have bid on Buyee and would like to know if this is a workable backup in case things don't turn out right.
