FRAUDULENT BUSINESS

ompany before, and STILL do business with them. PAYPAL still allows them to use their financial business platform to chanel their illegally manufactured products (Federal Trade Commission has 'requirements' before businesses can sell products in the USA). The cherry on the cake here is that this alleged (duplicitous marketing concept - using American images and stores) is actually a company in China. All of the items are shipped domestically, but secretly they come from China. Only issue is the BUYER is not aware of this, but clearly - PAYPAL are. I have contacted PAYPAL and advised them of this (as have other American customers based on google research), and what do PAYPAL do to protect their customers? Nothing. I have provided evidence that proves my case (including emails) and PAYPAL have done nothing. When you try to contact PAYPAL to speak with a human being, your are met with a computer-generated response and ZERO assistance. Leads me to wonder if a Chinese corporation actually own PAYPAL? Anyone know the answer to that?

Chinese Web Sites or on Social Media ads easy to spot (once you know the below signs) so buyer beware.

Paypal would not be able to check every individual seller / merchant / company in over 200 countries worldwide that adds paypal to their website to accept payments.

So they give some buyer and some seller protection. However that protection can never be a 100% coverall so you need to read it so you can risk assess your transactions.

They do stop bad companies from using Paypal when enough claims start rolling in.
However as they are in China (mostly) then its easy for them to just start over with a new name, so stopping them does not really do anything.

The best thing is to not buy from them in the first place, to recognise them -

1. No return address on the returns policy. The site will look as if its in your country (where they despatch goods from) but they will ask for returns to go back to China (returns depot) at a shipping cost often more than the item is worth.
2. No contact telephone number. if you click on contact the most you will get is webmail or an email address.
3. Rarely company address information.
4. Great pictures of items at bargain prices that turn out to be tat.
5. Fake reviews.
6. Google and you can often see previous company names as they change them once enough claims roll in and Paypal stop them using their services and start over.
7. Send fake tracking numbers to win item non receipt of item claims.

Actually, that's not quite accurate - far from it.  In this case, 'MyWesternOutfit'.com has been reported to PAYPAL on numerous occasions, and I provided emails, photos and PROOF of the claims (even down to Fair Trade Commission laws).  I spoke with a PAYPAL representative who informed me that the call was being recorded - to which I advised him that I was ALSO recording the call to PAYPAL.  This PAYPAL representative confirmed - and again, this is on a recording, that I can request a full refund from Bank of America and PAYPAL will honor my refund that way.  My concern (and it should be PAYPAL's too) is that: hypothetically speaking, IF I was to wear this non-labelled clothing on Halloween, and a lit pumpkin or light caught the dress.......this material (which has no labelling and is NOT the material it claims to be) could - literally, go up in flames.  America has federal trading standard laws when it comes to fabrics and materials - and everything SOLD should have manufacturing, and fabric construction on it's labelling.  This is for safety.  I pointed out this serious concern for PAYPAL - most specifically the 'safety' issues when PAYPAL don't act upon the written and documented evidence of a concerned consumer.  PAYPAL is supposed to protect American consumers bring serious issues to their attention - not ignore them and continue allowing Chinese companies that do NOT comply with American trading laws to operate on the PAYPAL platform.  PAYPAL have not displayed any willingness or concern for me at all, so I have asked my bank to refund the money and will then CANCEL my business dealings with PAYPAL.  I refuse to do business with a company that appears to protect Chinese business interests over the American consumer.  It's shameful and PAYPAL should do better.

U.S laws don't apply in China and they can sell fakes or whatever in China as its allowed.

If you imported the item then that would be your risk and no one else's unfortunately.

So you need to check you are not buying tat from China, I did once, chucked it in the bin, learned from it and moved on.

Paypal processes your payment to the seller of YOUR choice.

Firstly, I think you'll find there is a legal obligation to inform the buyer you are NOT an American company, but an importer - from OVERSEAS.  In this case, the website was duplicity staged as American, with American clothing - guess what.......no wording on the business being CHINESE.  Secondly, I think you'll find PAYPAL will have a million dollar lawsuit IF an American reported that the items paid for through PAYPAL platform were not legally fit for sale in the USA, were unsafe (in terms of materials and textiles).  This is America, and ALL imported business MUST conform to US safety standards.  Everything - no exceptions.  PAYPAL are knowingly allowing foreign manufacturers to use their monetary platform to sell non-legal items.  I suggest you check Federal Commission Trade laws.  You can't SELL items that don't conform to US safety standards - regardless of where you ship it from.  You must have a trading licence, and the goods sold MUST conform to American laws.  I don't make the rules - the US government does, and PAYPAL are ignoring them.  PAYPAL are at fault here - not the Chinese companies selling these products.  Just PAYPAL.  When PAYPAL are routinely informed that foreign companies - particularly those of Chinese origin, are selling their goods through their monetary platform, and those goods do NOT comply with American federal trading laws, then PAYPAL is complicity.  Don't you think?   If you don't agree - say so, and I will use all of these documents, emails and conversations when PAYPAL is reported to the fraud commission.  Any product - no exceptions - ANY product, imported to the United States of America is legally required to meet federal trade commission standards.  I don't make the rules, but they are designed to protect the American consumer - NOT to defend the dodgy corporations that facilitate foreign business interests.  Don't you agree????

China does not have to tell you anything of the sort.

If you want to buy from the U.S then best avoid ''social media'' and buy from a store in your own country.

Suggest you read this article which states ''know who you are purchasing from''.

https://www.cbp.gov/trade/fakegoodsrealdangers#:~:text=in%20your%20browser.-,Legal%20Implications,fo....

Its not illegal for China to sell them but its illegal for someone to purchase them and to possibly re-sell them in the U.S.

I'm intrigued.  Either you work for PAYPAL, or you are working for Chinese companies (online) that operate these businesses.  I think you are clearly mistaken.  My order was through an AMERICAN company.....lol....nothing remotely Chinese about it.......nothing.  Pictures, clothing, wording, legal disclaimers....NOTHING mentioned 'CHINA' at all.  Jeez....I hope that means when I place an order from Vineyard Vines, it's REALLY in America.....gosh.....it looks like it is.....sounds like it is......mentions NOTHING about China......etc, etc.  So, one assumes it MUST be an American company, right?   I bought from an American website (nothing Chinese, or with any Chinese reference in it at all), and ANYTHING imported to the United States of America MUST conform to LEGAL trading and licencing regulations.  PAYPAL facilitate such business operations on their monetary platform, and your words "......

China does not have to tell you anything of the sort.

If you want to buy from the U.S then best avoid ''social media'' and buy from a store in your own country...." proves my point.   I bought from a store in my OWN country.........only it was a 'scam' store, masquerading as an American company with illegal goods (don't conform to US regulations = illegal).  PAYPAL know this - they've been informed multiples times, and STILL protect the Chinese scam companies to the detriment of the American consumer.  Facts matter.   My bank will refund the payment to PAYPAL and PAYPAL can then 'fight' the Chinese company for the funds.  I will remove all my business from PAYPAL and use my American credit card company and bank.  Problem solved.

And there it is, don't like someone disagreeing with you then you accuse them of working for paypal or the Chinese websites.

How original........not 🤣

No, I am just someone who takes responsibility for my own actions and mistakes and does not need a payment processor to vet my purchases from me.

Suggest you read the link above. Clearly states its illegal to 'import' fakes etc into the U.S and also try and re-sell them.

So the onus is on you not to purchase fake or poor quality tat from Asia.

lol......No offence intended, but obviously you don't understand the law.  This is nothing to do with emotion. It's facts.  In America we have trading laws.  LAWS.  That protect consumers.  This is criminal, fraudulent activity - and we all know it, PAYPAL most of all.  I will get my money returned because the law - the LAW, is on my side.  Thankfully.  Such a pity for the other duped American citizens.  This is theft - pure and simple.  THEFT.   One good thing is that ore American consumers will BUY from American retailers.  American.  That wonderful word.  American.  I think we've both said enough...........different opinions - I favour the law, you don't.  That's fine.  Everyone is different, and clearly, we move in different worlds.  I prefer a world with laws and regulations.  Lesson learned here - you're right about that.  Now, I will ensure I watch this Chinese company like a hawk and display this information ALL over the internet.  One way or another, it will affect 'business' - not mine, theirs.  The power of the internet is a wonderful thing.  Thank you for your commentary - much appreciated.
