Paid for signed delivery item stolen?

Hi i brought a coat a coat and paid £6.99 for signed for delivery ,than the usual £2.99 standard , anyway royal mail tried to deliver it , posted a card through door saying try next day , anyway while at work next day email pings someone signed for my parcel and royal mail have a photo of it lent up my outside wall next to the door suprise suprise parcel not there when i arrive home , i contacted the seller and told them they said royal sent proof of delivery , but i didnt sign for it and i didnt give permission for the postman to leave it there , the seller basically said tough , ive disputed the transaction due to them leaving it outside and the postman signing for it , defeats the object really of paying extra , now as this transaction was done with paypal credit they seem to side with the seller yep they delivered to your doorstep its your problem now , but on reading up i am not a doorstep and its left there by the seller as i didnt give permission , now i always thought buy through paypal as your protected ,so i imagine im stuck with paying £181 for a coat i dont have , or can i pay the coat straight off and then chargeback through my bank who do seem to know uk consumer law on parcel delivery ?

To be honest if tracking shows the item as delivered then the seller would win any dispute.

So your issue really is with Royal Mail and I would be chasing them to find out why they delivered the item to such an unsafe place?

Under the Consumer Rights Act 2015, the retailer is responsible for getting the goods to you intact and in your hands. That means they are responsible for refunding you if there’s a delivery failure or alternatively, arranging for a replacement delivery. This isn’t up for debate – you should be refunded. The only exception to this is if you’ve specified that the parcel should be left somewhere specifically, like outside your front door or with a neighbour.

So just to be crystal clear, this means you are entitled to a full refund if you parcel is:

  • Left somewhere you haven’t authorised.
  • Left in a communal or unsecured area
  • Left with an unauthorised neighbour.
  • Left outside a door (then pinched).
  • Broken or damaged. This doesn’t have to be when the delivery person is there (as long as you don’t leave it too late to open it)

A photograph of a parcel outside a door does not represent proof of delivery. It just means a parcel has been left there. I have lost many a parcel to light fingered people passing through the foyer of my building when certain businesses hire couriers that just dump them all just inside the front door. So push back and demand a refund.

Paypal disputes and consumer rights are 2 totally separate issues.

If tracking shows an item as delivered then as far as paypal are concerned the seller wins any dispute for non receipt of item.  

 

Then if you have lost the dispute and 'if' the seller is based in the UK and 'if' the seller is a registered business then of course you have your consumer rights and can pursue them in the small claims court.

Dont need small claim ,So basically pay paypal credit straight up then chargeback through my bank ,who will side with me as its law,of which paypal have to prove that it was delivered so the sender gets paid ,i get refunded and paypal lose out because they have there own law sounds stupid
