Trainers of Ebay? Advice on what to do

Hi everyone. I will try make this as clear and short as possible. So I like my trainers and spend a lot of money on them. So i wanted a rare pair that can't be found in shops and went to ebay where I found a top rated seller, have seen feedback and everything is really good for the seller. I contacted the seller as they didn't have the pair I wanted in my size and was told they can order it in, so they sent me an invoice, I paid for the item. I was told right from the start it would take approx 2-3 weeks so I knew it would be a long wait, and also it wasn't trackable until it reached UK where the seller is, I was told all of this from the start so I knew.

I am now starting to get a little worried as this was something we did privately so no ebay listing, although I have the invoice in paypal and all email contact we have had as evidence. The seller does reply to me and told me recently that it they have got in touch and the trainers are still on their way could be anytime soon. I trust the seller but the wait has been a little longer then 2-3 weeks and I am starting to worry that the item will never come and as there is no ebay listing I may not get my money back in the case that I have been scammed. The seller has told me to be patient, but I feel as though I should contact paypal and just give a heads up to them as if I take too long to say something, they may say this is old news and we cant do nothing?

Paypal buyer protection does not just apply to ebay.

 

You have up to 45 days to file a dispute with paypal for item not received via the resolution tab in your paypal account > give the seller a few days to refund and if not then escalate the dispute to a claim > then if the seller does not provide a tracking number that proves delivery of the item to you then you should get your refund.

 

HOWEVER its too early to file yet, I would give at least 3 weeks before thinking about claiming.

Thanks for the reply kernowlass. The problem is I paid the invoice on Jan 18th 2013. As i was told in advance the delivery would take long I've waited, but now i have a slight feeling i've been tricked but I don't know as maybe I am being impatient, after all the seller is a 'top rated seller' on ebay etc, so im confused

Oh dear, well if its over 45 days you can't file with paypal.

 

In future never leave it passed 45 days > start a dispute on day 44 then you have another 20 days before you have to escalate > then once you have escalated the seller has another 10 days so that is 74 days in total.

 

If you get the item you can always close a dispute/claim or if the item turns up AFTER you have won a refund you can always re-pay the seller.

 

All you can do now if the seller does not refund and you do not get your item is if you used a card to fund your paypal payment then contact your card issuer and see if they will chargeback for you.

thank you for the help, appreciate it greatly. I add pay by card through paypal, an invoice was sent by the seller. All I can do now is hope I  get the item or else contact the card issuer like you said. Really hope the item arrives.

if you paid on january 18th then you still have time to file a dispute. its only been 35 days. i would file now because as kernowlass said, you can always close it if the item arrives

right I am going to dispute, and this is obviously done with the seller. I am going to let the seller know that I am doing this for safety precautions in the event something happens to the package. I will tell the seller once the package arrives I will give a postive feedback as I was warned about 2-3 weeks arrival, but this has taken longer so I am doing this as safety measures. 

 

So when I raise this dispute with the seller, I am not currently asking for a refund, as there is still a chance of it arriving. So do I tell the seller this is a worst case sinario fallback. I do apoligize for the silly questions, but this has never happened and I'm quite confused.

OK so its half time on the rugby so hopefully i can answer this better.

 

Yes open a dispute > that just allows communication between you both and you can tell him it is precautionary.

 

BUT YOU MUST escalate to a claim within 20 days or the dispute will close.

 

If at any time the item arrives then you can close the dispute or claim and if you get a refund and it turns up you can ask the seller for an invoice and re-pay.

 

Keep an eye on the timings.
