Seller (GearBest) admits to no delivery - PayPal rules in seller's favour!

I apologise for presenting again my case - with the latest developments The laptop I ordered from GearBest was never delivered. The seller admitted to that - I have copies of the correspondence - they promised to proceed with refund. I raised the issue with PayPal and provided copies of the seller's messages admitting that the item had returned to them. PayPal's response: they cannot rule in my favour because GearBest provided a ''valid tracking number''. They ignored the fact that GearBest have admitted that the item was never delivered.

Can you see the tracking number and track it yourself to see if the dates checks out? Were you given a tracking number that says the item was never delivered?

The tracking number showed delivery to me on 10 October

I got online with GearBest (online chat) and reported that I had not received the item - I was asked ''to wait a few more days''

On 20 October I issued a ticket with GearBest.

They admitted that the item had been returned to them - I have records of their messages - they promised to proceed with refund

Still 2 weeks later, since there was no refund coming through, I took it up with PayPal.  Their response ''there is a valid tracking number''!!! They ignore the fact that the seller admits that the item was never delivered to me

In summary PayPal hides behind ''the valid tracking number'' and GearBest keeps promising refund which I am not getting. Even yesterday they sent me a message asking me (once again) to wait two more business days - it is the fourth tie they have done that!!!
