Sided with seller when they lied

I opened a dispute after the seller had sent me items, when I received the items they were not what he said they were! They were damaged, he was not willing for me to get my money back and send them back at my own cost, so I opened this dispute, he basically lied in his post to paypal and they automatically sided with him, they never asked for more info from me and just closed the case! My question is how do I get this resolved, when the seller is just willing to lie to cover himself. I can even send pics of the damaged products I got, but it also said in the email that:
Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund.
SO does this not pertain to fraud when he sent me damaged products??

According to Paypal policy, you are covered regarding the quality of goods for stuff with Ebay/Paypal buyer protection. Otherwise, you are only covered for the shipment of goods.
In short,
NEVER BUY ANYTHING ON PAYPAL/EBAY WITHOUT EBAY/PAYPAL BUYER PROTECTION....
A smart seller would just take your money and send you a rock with signature confirmation to prove delivery.

That doesn't even make sense.
If a seller sends you a rock in a box on ebay, you file and win a dispute.
If a seller sends you a rock in a box on a NON-ebay sale, then you're pooched.
If you used a credit card to pay for the item, file a chargeback by calling the customer service number on the back of the card.

So are you guys basically saying I am out this money, and that I can't appeal or even tell paypal the truth with pictures and messages? So this kids gets to walk away with my money and I have nothing but unusable damaged goods to show for it!!
